In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check back occasionally for updates.
An order is not binding upon Herbalmax.com until it is accepted; Herbalmax.com must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Herbalmax.com. You agree to pay the amount(s) due as specified on the invoice.
Herbalmax.com strives for accuracy in all item descriptions, photographs, references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our website. Due to human error and other determinates we cannot guarantee that all item descriptions, photographs, references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our website is labeled with an incorrect price due to some typographical, informational, technical or other error, Herbalmax.com shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information. Additionally, all hyperlinks to other websites from Herbalmax.com are provided as resources to customers looking for additional information and/or professional opinion. Herbalmax.com does not assume responsibility for the claims and/or representations made on these or any other websites.
Limitation of Liability
In all circumstances Herbalmax.com's maximum liability is limited to the purchase price of the products sold. Herbalmax.com shall not, under any circumstances, be liable upon a claim or action in contract, tort, indemnity or contribution, or other claims relating to the products it sells which exceeds this liability limit. Herbalmax.com shall not be liable for third party claims for damages against the customer, or for loss of business, loss or damage to exemplary damages, whether or not Herbalmax.com has been made aware of the possibility of such claims or damages.
Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Herbalmax.com and Customer shall be governed by the laws of the State of California, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Herbalmax.com and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of California, Los Angeles County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Herbalmax.com that is more than one year after the date of the applicable invoice.
Sales tax is only required for orders shipping into states where we have or may have nexus for state tax purposes under applicable laws. Therefore all orders shipping into California will be charged applicable sales tax according to your area's tax rate.
You can expect your order to be processed within approximately 1-3 business days, provided the items are in stock and there are no problems with payment verification. Herbalmax.com does not guarantee same day-shipping. Orders are not processed on weekends and holidays. The shipping method you choose determines the additional time it will take to deliver.
How much is shipping?
We refer you to your shopping cart, that’s the best way to estimate your shipping costs as shipping depends on product, quantity and location, there are also multiple shipping options.
How do I track my package?
After your order has been processed by our sales team, we email you your tracking number. You will track your order using that number. Keep your order number handy, however, we can always look it up for you if you don’t have it on hand.
When will my package arrive?
Delivery timeliness depends on the delivery option you chose at check-out, and is subject to holidays, weekends, weather, stock levels, order volume and delivery variances, all of which are out of our control. We can never guarantee a delivery time or day and cannot hold stock for pick up in our HQ or associated offices, and do not hold orders for future delivery.
We ship to most countries including USA, Canada, China, Japan, Australia. If you are in doubt of whether we ship to where you live, please email firstname.lastname@example.org to confirm.
International shipments are subject to customs duties and fees (including a custom's wait periods or delays), which are taxes imposed on goods when transported across international borders.
Herbalmax and its affiliates will not be held responsible for any fee and or duties charged by a country in relation to international shipments.
All duties and taxes are to be paid by the customer, including but not limited to any international returns.
For any international return where Herbalmax is charged on behalf of the customer, Herbalmax deducts customs-related fees from the overall value of the return.
If you believe your package has been lost, we refer you to your postal carrier. It is very important to keep any tracking information in your possession; in this way your carrier will be able to visually pinpoint if your package was delivered. Often times the postal carrier will use photographic evidence and signatures upon receipt to help locate any lost package claim quickly.
Herbalmax does not control your package once it leaves our warehouse although we can assist you with reminding you of your tracking number or carrier information.
Herbalmax.com will not be held accountable for lost or damaged packages. We recommend customers to ship return product(s) insured and with a tracking number.
- Your order's estimated time of arrival = processing time + travel time.
- "Travel Time" does not include weekends and holidays.
- Exact delivery times to overseas cannot be guaranteed.
When returning unwanted product, the customer will be subject to shipping costs when the Economy Shipping (Free) option was previously selected.
Economy Shipping costs are paid by Herbalmax in good faith for the benefit of the customer, any returned product in which the Economy Shipping option was used and the customer incurs the cost of the shipping when/if it comes time for refund.
Only when Herbalmax receives the unwanted product back from the customer and determines the viability of the product, and the product can then be deemed un-tampered with, will sales staff return the cost of the product only to the customer - MINUS economy shipping costs.
Additionally, if the customer had previously selected a premium shipping option, the customer will only receive the value of the product in return, not the shipping cost.
Shipping costs are subject to changes throughout the calendar year.
All related fees (shipping & return shipping fees) are NON-REFUNDABLE for all products in all cases.
How do I resolve my issue?
We ask you please email email@example.com and include as much information as possible, such as your order number along with any photo documentation if appropriate, when contacting customer support. Our dedicated team will do their best to answer your questions or resolve your issue as quickly as possible.
Can I speak with someone directly?
Of course, although we recommend emailing concerns to firstname.lastname@example.org first, in that way we can respond to you with the information regarding your query, we also have customer support staff on hand to answer any inquiries at our HQ office on 949 232 1166 during normal business hours.
Please expect delays in response to your inquiries made to our support staff over national holidays, weekends and in-between normal business hours.
Customer is to report missing product(s) lost or damaged to Herbalmax.com within 48 hours of delivery of the product(s). Failure to do so will results in the forfeiture of Herbalmax liability.
Products sold by Herbalmax.com are covered by a 30-day return period. All returns covered under our thirty (30) day return policy are subject to the following:
- Herbalmax.com may charge a 5% handling and restocking fee with some returns.
- Herbalmax.com does not offer money-back guarantee on any product.
